Christmas Came Early for Pro-Lifers: "Leaked" Opinion Says Roe v. Wade Has Been Aborted
The legitimacy of the document has been confirmed by the high court
According to an article published by Politico on May 2, 2022, a preliminary draft of the Supreme Court’s decision in Dobbs v. Jackson Women’s Health Organization, a case currently pending in the high court, declares the infamous Roe v. Wade decision and its progeny, Planned Parenthood v. Casey, overruled. These two cases secured a woman’s right to an abortion in the United States, a right allegedly derived from the Constitution itself. It goes without saying that the right to obtain an abortion has been both highly celebrated and vehemently condemned, depending on who you ask and what state you’re in.
The Dobbs case currently before the court is a challenge to a Mississippi law that bans abortions after 15 weeks gestation. The decision in Casey declared that any state limitation on abortions pre-viability of the fetus constitutes an undue burden on a woman’s right to an abortion and is therefore unconstitutional. According to the allegedly leaked draft Dobbs opinion, Mississippi’s 15-week limit is weeks before viability, thereby violating Casey and Roe. Dobbs asks the court to either reaffirm Roe and Casey (nullifying Mississippi’s law), or overturn them, returning the issue of abortion back to the states (who had the power to regulate or ban abortion pre-Roe).
Politico proclaims the leaked draft opinion is legit, but I would wait for a final rendering before raising your pitchforks or throwing a party for all the saved future fetuses.
